Introduction

Welcome to CharGen. These terms and conditions outline the rules and regulations for the use of CharGens Website and services. By accessing this website, we assume you accept these terms and conditions. Do not continue to use CharGen if you do not agree to take all of the terms and conditions stated on this page.

Our Disclosures

Our complete terms are contained below, but some important points for you to know before you become a customer are set out below:

  • Once your Artwork has been created and delivered to you, all Intellectual Property Rights subsisting in that specific Artwork is transferred to you, and you may use your Artwork for personal or commercial purposes. However, we provide no warranties that you will be able to trademark or claim copyright ownership of our Artwork or that any trademark application or copyright claim will not infringe on any third-party Intellectual Property Rights;
  • Unless your Membership is suspended or terminated in accordance with these Terms, your Membership will roll over on an ongoing basis;
  • We may cancel, at any time before delivery and for whatever reason, an order that we have previously accepted. Where we do so, we will refund you using the original payment method used for the order;
  • We may need to change the Membership Fees from time to time. If we change the Membership Fees, we will provide you with 30 days notice of the change. After 30 days, we will apply the new Membership Fees to your Membership. If you do not agree with the new Membership Fees, you may cancel your Membership in accordance with these terms;
  • We may terminate your Membership at any time by giving 30 days written notice to you;
  • Our liability under these terms is limited to the Price paid by you for the Artworks and/or service the subject of the relevant claim, and we will not be liable for consequential loss;
  • We will have no liability for loss of, or damage to, the Artworks, any injury or loss to any person, failure or delay in providing the Artworks or a breach of any law, where such loss was caused or contributed to by any event or circumstance beyond our reasonable control or act or omission of you or your related parties;
  • We may amend these Terms, the features of the Site or your Membership at any time, by providing written notice to you;
  • You indemnify us from and against any liability that we may suffer arising from a claim that the content you submit to the Site infringes, misappropriates, or violates a third partys rights;
  • We may receive a benefit (which may include a referral fee or a commission) should you visit certain third-party websites via a link on the Site or for featuring certain products or services on the Site;
Nothing in these terms limits your rights under the UK Consumer Law.

User Content and Usage Rights

CharGen allows you to generate and share content. You retain ownership of the content you create. By using CharGen, you grant CharGen a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your content in connection with the service.

Prohibited Content

CharGen does not permit explicit sexual content. The following are blocked and will result in content removal or, where the law requires, immediate account termination: sexual content involving minors (real or fictional), non-consensual or deepfake sexual depictions, and extreme or violent sexual content.

Subscriptions

CharGen offers Plus, Elite, and Ultimate subscription plans. Basic is a legacy plan that is no longer available to new subscribers but is still held by some existing ones. Each plan grants gold every month. Subscriptions renew automatically each month unless cancelled. By subscribing, you agree to pay the applicable subscription fees and any taxes incurred.

Gold

Gold is the credit you spend on premium content generation, different models, additional images, and other paid features. You can get gold in three ways: a monthly grant included with a subscription, a one-time gold pack bought on its own, or free gold earned from daily logins, tasks, streaks, and competitions. You can also generate content for free without gold, though premium features may require it.

Gold does not expire. Whatever is in your balance stays there for as long as your account is open, whether you bought it, earned it, or received it with a subscription.

Purchased gold is never capped. Gold from a one-time gold pack is always added to your balance in full, no matter how much gold you already hold.

Unused monthly gold rolls over. Your Gold Bank holds up to six months' worth of your plan's monthly allowance: 5,400 gold on Plus, 12,000 on Elite, 27,000 on Ultimate, and 1,800 on Basic.

The Gold Bank is a limit on how much gold you can hold at any one time. It is not a limit on how much gold you can receive or spend in total, and it is not an annual or lifetime allowance. If your Gold Bank is already full when your subscription renews, that month's gold is not added. Spending gold makes room again, and your next renewal tops you back up as normal. The Gold Bank applies only to monthly subscription gold. It never reduces gold you already hold, and it never applies to purchased gold packs, which are always added in full. We will give at least 30 days' notice in the app before reducing the size of the Gold Bank.

Limitation of Liability

In no event shall CharGen, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. CharGen, including its officers, directors, and employees shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this Website.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the United Kingdom, and you submit to the non-exclusive jurisdiction of the state and federal courts located in the UK for the resolution of any disputes.
